My girlfriend has been living in the US illegally for 13 years. She was brought over by her parents when she was 12 years old and has completed Jr High and High School in the US. Is there some way she can gain permanant residency or citizenship due to her circumstances?

**A: only if she got straight A's and a GPA of 4.0 or better the entire time, is involved in community service activities, is going to a college, has declared her double major and has a job to fund her education.

She cannot apply for permanent residence if her parents were also illegal. If her parents were United States Citizens or if one was a USC and the other a Permanent resident she may be able to apply. If she surrenders to INS she could apply for suspension of deportation if she meets the criteria. However, the suspension can also be denied and she will have to depart the US.
