What happens in MO if a child was born in the Us but the mother is illegal. If immigration catches her do they deport both of them? Do they take the baby away from her?

I believe that a child born in the US automatically becomes a US citizen, unless the parents petition to give the child a different country's citizenship (for example a foreign exchange student planning to return to her native country, etc. ... may do so). By default, the mother of said child (and sometimes even the father) should be able to receive a derivative legal immigration status.

Not true.. otherwise everyone who wanted to stay in the US would be getting pregnant or arriving in the US when 8 months. Regardless of the fact the child is born on us soil, if the mother is deported, then unless she wants to hand the child over to the father (if he is allowed to stay), then the child goes with her. They do not deport the child, it is up to the mother to sort that out.

When the child is old enough it can petition the mother as a family member. That is the only status that the mother is automatically granted.
