    immigration/marriage issue

    What is the name of your state? Wisconsin

    I am a US citizen, engaged to a Canadian citizen. We are both currently living in Canada. Our plan is to move to Wisconsin this summer, marry there in September and live there permanently. The timing for the fiance visa will be cutting it close. My fiance is an engineer and therefore is eligible to get a TN-1 work permit. If my fiance goes to the US on a TN-1 visa (instead of a K-1 fiance visa), can we get married (without a long wait) in the US, and what would be the ramifications (if any) on the process for filing for permanent residency? Also, after we are married is there some period of time that he can not leave and re-enter the US? We were planning on having a reception in Canada a couple of weeks after our wedding in Wisconsin.

    The ramifications are commiting visa fraud & being banned for life from the US. The TN is not a dual-intent visa; to get one, he's supposed to be returning to Canada.

    You would be much better served by seeing an immigration attorney in private to make a plan. btw, I am NOT an attorney and don't think that everyone needs to see one, but IMO you do.
