immigration question


My boyfriend, whom is 31 is currently on probation for 3 years for 3 violations: hit and run, traffic violation and driving with out a Drivers License. He is illegal in the US, but I was born here in the US. If we marry, is there the possibility that he will be sent to Mexico, his native country, for a few years?

Did he enter the country legally?

Then the question may be moot - even if you were to marry, he cannot adjust his status at all.

would u say that mostly because of his entering the US illegally? so then, there wouldnt be a possibility of him becoming a US citizen?

Yep - even without the criminal background. The fact he entered illegally means he cannot adjust status at all - unless the law changes in the future. He cannot obtain residency and he cannot become a US citizen.

The US isn't interested in having a person who has had a criminal background becoming a citizen.

Alas that does happen - depends on the actual criminal history. But in this case it's moot anyway...he entered illegally which precludes him from adjusting his status for that reason alone.

OP, even if he'd entered legally and overstayed he'd have his criminal history to overcome and that is NOT easy to do.

Start your research with "I-601 waiver". He will have to leave the country; how long will be up to you. The I-601 process will deal with the illegal entry. The other charges may require a further waiver.

Do you think he really has a chance at obtaining the waiver? Don't get me wrong - I know it's there and that there's no chance at all without trying for that waiver but in these circumstances?

No idea really... what's messed up is that he gets 3 years probation (at cost to the local taxpayer) instead of an ICE referral.
