L1 to H1 transfer exceptional case


What is the name of your state? or

Hi
Some one please help me.

On June 18 2005 my H1 is stamped and the consultant who have filed my H1 has not got the project so he did not get me to USA.

In the mean while my current company processed my L1 and during stamping consulate cancelled my H1 Visa stating that they can not allow multiple visas at any point of time.

I came to USA now on L1 visa along with my family and staying here since 4 months.

Company which filed my H1 came now with an attractive salary and good offer to work in US.

My question is can I get H1 now in any way with out waiting for next year quota? is my petetion still valid? is my Visa only cancelled or my Petetion as well.

Some body said my petetion is still valid so I can go out of USA and get a fresh stamping again on the same petetion and come back to USA. is this correct?

Please help me and give me best option.
