L2 EAD to H1

Hi,
I am in L1 Visa and my spouse is in L2 EAD visa and working in L2 EAD since Nov 2011.

My L1 Visa is valid till July 2013.

My situation is i have to go back permanently to India due to a personal reason.

I will be still continue working with the same company XYX in India.

Can My husband still continue work in L2 EAD ?

Also If we apply H1 Visa for her in April 2012 , from when on can she work in
H1 Visa?

Kindly please help!

If the principal is no longer in L-1 status, then the spouse cannot remain in L-2 status. If the H-1B visa petition is approved, it will become active on October 1, 2012, at the earliest.
