One more problem in my Green Card application!!!


What is the name of your state (only U.S. law)?
TEXAS

Again, we find something might become trouble in my process to get green card.

My mother (a US citizen) filed the I-130 (unmarried child of a US citizen) for me in 2003 while I was studying in the U.S. and was single. The petition case was approved in 2007. While I was still waiting for green card, I met a woman from my home country with H-1 VISA and got married soon after. We did try to inform USCIS about the change and also express the intention to add my wife's name in the application, but were told that the case had been approved and closed (for the USCIS's part).

Now my mother wants to file I-485 (as the priority date has been current for several month) for me, but I really afraid that USCIS may consider me cheating and deport me (even though my I-20 is valid). Will that happen?

By the way, I have been studying legally and continuously in the US (got one master's degree and working on the PhD degree in a field that requires longer time to graduate).What is the name of your state (only U.S. law)?

No duh, it IS cheating.

Is your PD current for a married adult son? If so, use your approved I-130.
If it is not current, you wait.
