My friend is from the Philippines and came here on a fiancee visa. Now, she has a temporary greencard. She is pregnant and wants to go back to the Philippines since her U.S. citizen husband cannot support her. She is a very educated woman with a doctorate degree in the Philippines, but because of her situation, she is rummaging the dumpster to find cans and bottles, scrubbing toilets and getting up at 1:30a.m. to do newspaper routes just to survive. She wants to know if her husband has the right to stop her from leaving the country or file criminal charges against her. If she can go back to the Philippines without any problem and have the baby there, is the baby, which is born in the Philippines with a U.S. citizen father, a half citizen? What are the requirements for the baby to come to the United States later in life.

If the baby is born here in the United States and taken to the Philippines with the father's consent, how long does the law allows for the baby to stay in the Philippines.

Please help. My friend is very desperate.

Sincerely,
