What is the name of your state? VA

In part 4, question 6 of the I-140 application, the employer is asked whether the employee has ever had any petition filed on his behalf. In my case, I, the employee, had a petition filed a couple of years ago by my wife and retracted before being processed. However, I did not share this information with my employer because I consider it private. Consequently, my employer's response to question 6 will be 'No' since they have never filed an immigrant visa petition on my behalf and they have no knowledge of any petition filed by my wife.

I would like to know if I am legally required to inform my employer of this fact which I consider private? However, this being said, I do plan to share this information directly with USCIS in part 3 of my I-485 application.

I would appreciate any advice in this situation.

Thanks

It might be more confusing if this information is not disclosed on this application (I-140) but then is later disclosed on the I-485 since it will be seen as a discrepancy and might be an issue for a RFE.

Please let me know if you have any additional questions or how I can be of further assistance to you in this matter.
