Question

Is she legal to be here?


What is the name of your state (only U.S. law)? florida My husbands Columbian girlfriend keeps popping up and of course my husband is not going to tell me the truth about her visa status. My husband and I are not yet divorced due to us having a "mom & pop" buisness that is slow to sell. We both have to live there and work there, so of course the girlfriend is there as well. I know he met her in Miami a year ago March and she moved in with him in Florida last Fall while I was on vacation. Last fall she got a DUI in Monroe county that scared the crap out of her and apparently she went back to Columbia to annul her marriage to a gay guy she married for her green card. She has children in Columbia and goes back and forth. She works as a bus girl in town and I know she does not have her work visa. Of course I would never permit her to work at my business. She has been in Columbia now since 09-21-09 and is due to come back to FL in November. I really would like to get her out of my hair and sight but I have no idea about immigration laws. What is the best way to determine if she is really "leagal" to be in the U.S.What is the name of your state (only U.S. law)?

Hire her and have her complete the required form I-9.

There really isn't any way for you to find out through regular channels. Info you get from her, your husband or her friends probably won't be reliable.

Where will she stay when she comes back in November?

You can get her out of your hair by ignoring her. You're already divorcing the guy. It's the GUY you should have a beef with. I mean, HE'S the one who made all those lovey-dovey promises to you at the marriage ceremony. Or, are you saying that they BOTH stood up and promised to be faithful to you?

Well, I would not hire her as she speaks very little English and her marketable skills in our little tourist town are limited to busing tables in the latin style restaurants. She does not have a work visa. When she is on the property where we have our business she lives in one of our homes there with my husband. I will just have to visit authorities in town once I get back there in a few weeks--I see that this forum can not offer the help I need. Thank you anyway.

the authorities won't do anything for you.

you were given an "option" to actually get the exact info you are looking for in a legal manner. you wouldn't actually hire her, but start the process of doing so. which gives you access. to what you want to know.


it was a sneaky idea though!!!

Yes--I understand that, but my husband is there also & would never permit her to give me any info. I will work on other ideas such as speaking with her employer that has hired her without the proper work permits she should have, etc. Thank you again.

Oh! lol, I didn't actually think it through that far. I was just thinking about the legal ways to get the information.

What we are trying to say to you in various ways is that you have no right to that information. It's her private information. Unless you become someone she would share it with (like an employer/employee relationship) there isn't anything else legal you can do.

and they don't hunt immigrants down because the soon to be ex suspects something. you don't KNOW. you only know what you think you are being told.

LOL Yes I see! My job will be just to make sure she does not get employed in town because she must pay me rent while there and the husband does not have conrol of the money to pay her rent. Oh, sorry, have to go now....Jerry Springer is on the phone......

You have to think these things through from all sides islamelia. If the employer hired her without the proper documentation, --he-- gets in trouble too. Are you sure he's going to tell you?

Now that's cutting off your own nose to spite your face! Sounds like it's in your best interests to see that she --is--working, so she can pay the rent.

Glad to see you see how it all sounds.
Really, why bother. You're divorcing the guy, who sounds like a real prince (not). The happier he is, the easier your divorce will go. She's doing good work for you!
