Sponsoring a parent


What is the name of your state?
New Jersey
I am a US citizen who would like to sponsor my mother. She entered the country illegally 15 years ago. What should I do in order to get her a legal status? I don't wish her to have to leave the country if possible. She has never applied for legal status and has never been in troulble with the law.

Sponsoring a parent


While you CAN petition for your mother, she will be denied her visa because she entered illegally. While there is a waiver, your mother will NOT be eligible to file the I-601 unless she has a spouse or parent who is a USC or LPR. Only the spouse and/or parent of the applicant are considered qualifying relatives for an I-601 for unlawful presence.
