What is the name of your state? MD

Situation: person from Barbados who needs to get SSN for child support hearing who has been working for under the table pay on expired visa.

Can they get the SSN??
And if not what will happen to them???

If the person is here unlawfully (authorized period of stay expired, as per I-94 card), then that person is not authorized for any social security number. Additionally, if the status the person originally had upon entry is not the type of status that authorizes one to have a social security number, then even if the person's period of stay were not expired, he/she would not qualify for a social security number.

The person may be able to get an ITIN from the IRS in lieu of a SSN.

If the person has no legal immigration status in the US, yes, there is always a possibility of that (it's technically called 'removal').
Whether that would happen as a result of going to civil court on an unrelated matter, there is no way to know.
