    will he be whisked away at the airport??

    What is the name of your state?What is the name of your state?
    California

    My husband grew up in the states for 18 years although his mother never applied for citizenship. After getting into trouble with the law (more than once) he deported himself voluntarily. Its been 6 years now that he hasn't returned, I have looked and there are no outstanding warrants is he able to return to the states just to visit or will he have problems??

    Are you in France or California? Where is your husband?
    Many people flee to France to avoid extrdition.
    Are you still married?
    Of what country is your husband a citizen? Valid passport?
    Does he have a visa? Has he applied for a visa?

    I pick 'B' "he will have problems".

    His ban from entry is surely 10 years, if not for life. Depends on his criminal record. I should ask, did he ever have a Green Card or I-551 in his passport or did he know if he was a Permanent Resident?
    Not that it is going to help.

    We are currently living in France as he is a french citizen, with the intentions to move back to Australia as that is my home. He has a valid passport but no he has not applied for a visa as we are not sure if he is able. His mother still lives in San Diego and we would like to visit with our son.

    Anyone with the $100 or so is 'able' to apply for a visa. His only option is to apply for a B1/B2 visitor's visa at the US Consulate in France. You will get either:
    -A really fast NO
    -A really long wait and then a NO
    -A really long wait and a 'yes' that is actually a 'maybe'. The final decision on whether or not he may enter the US comes from the ICE officer working the border when he enters.

    PS: the child may certainly visit France, Australia or any other country where you are all allowed entry.
