Attorney Fees (Time charges, Contingent, Court Award) What is the name of your state (only U.S. law)? New York
I am retaining a lawyer on my employment discrimination case that we are suing on Federal courts.
The current proposed fees are:
(1) 10% of the time charges PLUS
(2) 35% contingent fees on any recovery PLUS
(3) Attorney fees awarded on court
I thought that it will be fairer if the total fees be the higher of (2) or (3). Isn't (3) meant to reimburse the plaintiff for any attorney fees? It just seems like the lawyer is paid twice.
Any thoughts or advice will be greatly appreciated. |
