my wife has an eeoc investigation and a charge letter is about to go out. the eeoc investigator says the employer said awful things about her to him. if these things can be shown to be false, does she have a defamation of character case against the employer? this occurred in georgia

Almost certainly not. An employer saying nasty things to the EEOC investigator in the course of an investigation she triggered, however justifiably, isn't going to be enough for a defamation charge. The employer is entitled to his opinion and he is entitled to express it. Now, if he made statements that were factually incorrect (as opposed to a negative opinion) to an outside party AND she suffered some form of damages because of it, then she might have a cause of action. Just expressing a negative opinion won't cut it.
