What is the name of your state? Michigan

Can anyone tell me--

If time spent in mediation is paid time from my employer? Or can they tell me I have to take vacation, etc. I have a hearing coming up in a few weeks.

There is no legal obligation for your employer to pay for your time unless you are an exempt employee and are absent only for a partial day for the mediation meeting. That has to do with the Fair Labor Standards Act however, not any EEOC requirements. Even if you are exempt, your employer can allocate that time to your vacation or other paid time off benefit.
