Employer dictates Dr. appts.?

I am writing on behalf of someone who is afraid to be identified as yet. She works for a private corporation which functions with 4 "busy times" per year (of approx. 6 weeks duration each) alternately with 4 "slow times". The employee is recovering from post-op. Lung Cancer, has a heart condition, and Carpal Tunnel syndrome. Job is low level clerical/office work. The company will not allow her to go to a doctor during "busy times" even though the doctor(s) have specified exactly how many week intervals they need to see her. Her work day is from 8:30 to 5:30 M-F and no doctors see patients outside of that structure. She has offered to her employer that she would take vacation day or half vacation day for appointments or even take the time without pay just to be able to comply with her doctors' orders and maintain her health, but company refuses. She has been told she must cancel appointments and must never make appointments during busy time or be fired, and when in a doctor's office and scheduling next visit, must call the employer from doctor's office to ask what day she may make the next appointment. She needs Carpal Tunnel surgery, but cannot have the surgery when doctor wants it done, but must risk irreversible nerve damage and wait until her company says she can have it. Employer has not put any of this in writing, no doubt as a consious decision. It seems to her and to me that the employer is overstepping their boundries and interfering with an employees health care and personal business. Everyone says "quit this awful place" but employee is 79 years old, has benefits, insurance, etc. and fears (probably correctly) if she quits or is fired she will be unable to get another job at her age, however cannot afford to live without an income. We know of another elderly employee who had a stroke and died because she was unable to go to a specialist in a timely manner when her MD found something suspicious and ordered her to go to specialist immediately. Naturally we cannot prove this. What can she do? What can I do to help her? Is the above in any way illegal or unlawful or under the control of any kind of agency or employee's rights? Can anyone help us or refer us to resources that can help us? Thank you for your time...

How long has she worked for the company and how many people work for this employer?

She has worked there 3 years and there are about 150 employees.

Well then, as long as she has worked at least 1,250 hours, her employer had better start rethinking how they are doing things. There is a law called the Family Medical Leave Act (FMLA). Under this law her employer must allow her to take up to twelve weeks all at once or intermittently (which she probably needs intermittent leave for her doctor's appointments) for her own serious illness, no matter how "busy" they are. From the way you describe her problems she should definately qualify. She needs to go to someone in HR and explain the seriousness of her medical condition and the need for immediate treatment which she may or may not be able to schedule around work. If they give her the run around she should call the Department of Labor Wage and Hour Division (they deal with FMLA violations). And not allowing an eligible employee to use FMLA is a violation of the law.

I just did a little checking and it seems that Connecticut also has their own leave law called the Connecticut Family & Medical Leave which is similar to the federal FMLA law but reduces the amount of hours an eligible employee down to 1,000. If she has any problems or wants to call just to clairify that she is eligible she can call (860) 263-6785.

If the employee is eligible for both the Federal and the state law, she gets the better of the two.

OfficeFriend, I'll go ahead and give you the best advice anyone of these fruitcakes can give you on this website....do NOT waste your time on this website asking these morons questions. They are NOT attorneys, nor do they know what the hell they're talking about. They might appear to use "big words" and think they know the laws of the United States, but they DO NOT!!!! I've posted on various parts of this website just to see the responses I'll get and it is a huge joke!! Go get a free consultation from a hometown lawyer and your friend will be MUCH better off.

I bet it would shock you if I told you that I was a law student who got on this website to see how much knowledge you people had about these topics. As far as jobs go....you people are really desperate for one it sounds like! Are you on welfare?? You obviously don't have a REAL job!

My friend, if you were any kind of law student who had actually cracked a book, you wouldn't have had to ask those simplistic questions in the first place. The answers could have been provided by anyone who had even dropped in on "employment law 101."

Amen. If unfarerevue worked for me, I'd DECREASE her pay, not increase. She's made it quite clear that she is posting on this site while she is at w o r k - Which means the company which is treating her sooooooooooooooooooo pooooooooooooorly is paying for her to sling insults and bad air at anonymous posters on an advice site? Seriously, at my company WE CHECK EVERYONE's Internet use and e-mail usage - We have strict guidelines regarding using the Internet for personal use. If any of our employees waste their time using the Internet for personal use, they are reprimanded - if it continues its grounds for dismissal.

I wouldn't be surprised if unfarerevue looks for jobs while she's at work. Basically - she is lucky to have a job.

Yes, that's exactly correct. We all flunked out of law school and used our welfare checks to buy computers so we could spend our days giving out bad legal advice.

But as it turns out, we still know more about the law than you do. :D Amazing.

I spend a great deal of time on the p h o n e at work and this site enables me to see another strain of people - Idiotic posts like yours are the ones that are a cut above the others.

Seriously, do you think being the owner of a company is easy? If we lose a client do employees take pay cuts or owners? Who is first to work and last to leave - Employees or Owners? Who is the first to whine about not being treated 'fairly' - Employees or Owners?

Do you think I really care what you think of me personally? The answer is NO - I just think that you should be grateful that you have a job which enables you to waste your time/energy on posting to this site. When reading your posts its apparent that you do not enjoy your job and/or the company - you should find a better job that meets your skill set, perhaps a comedian or pilot?
