What is the name of your state? New Jersey

I am searching for a case which I was able to find on the internet a few years back but can no longer find. The specific ruling in this case read " There is a precedent that the burden of initiative in such matters is on the employer, in consideration that the employer holds the higher level of empowerment in employer/employee relationships."

Or in other case which supports a similar concept would be helpful
