Holiday Pay


New Jersey,

Since I am the only Jewish person works in my company, when I asked for Yom Kippur off the told me I have to take it as a personal day. I told them I would be glad to work on their holiday and they said it didn't work that way. I am losing my personal day because I am need to take it for the Yom Kippur. Can you please tell me if this is legal, when all others have off on their religous holidays with pay.

I ALWAYS have to use my vacation time for jewish holidays that I take off. Just like christians have to use vacation time for any holiday that the office isn't closed for (easter) and anyone of another religion would have to use vacation time for any of THEIR holidays. The only religious holiday that most businesses are closed for is christmas, and that's mostly because of the cost-benefit ratio of remaining open. And if you worked for a company that stayed open on christmas (chinese restaurant, movie theater), you'd need to use vacation time to take off on that day too.

The only thing the company has any obligation to do is give you the time off that you need for religious reasons, so long as it doesn't place an undue burden on the company. They are NOT required to pay you for the time that you are not working, outside of whatever PTO policy they have in place.

Not all others have their "religious holidays" off with pay. Employers decide which holidays they will designate as paid. Anything else, for whatever reason, needs to be coordinated with the employer.
