On the job Sexual HarassmentWhat is the name of your state (only U.S. law)? Georgia Hi and thanks to all who read and respond to me with a clear view of where I stand with this issue. I became a victim of sexual harassment and intimidation while working for a major retailer in Georgia. The company preaches a zero tolerance for sexual harassment, they make you watch video's, read their policy on it give you a test to make sure you understand what sexual harassment is and the consequences before you sign their policy on the subject so there is no question. I am female and had a male co-worker that like to make comments about me and to me. He never tried to hide it from other co-workers, customers or managment. I had several customers complain to managment about him but nothing was ever done. I went to managment several times and eventually ended up calling corp. so I could get results. Several male co-workers went to managment on my behalf. After my call to corp. the managment team I worked with assured my it was taken care of and would not happen again. My hours were changed, nights, weekends 4 hour shifts, early mornings, my duties were changed when ever managment on duty decided to change them even if I was with a customer. THe harasser still kept his job, kept his hours and still said things to me. There were days that I would call in sick for work in the parking lot because I would see his truck and it would make sick, very sick. But to make this long story short I have written statements from co-workers to managment about the harassment, my job duties and hours became unbearable, and the harassment continued. I quit my job over it. Do you think I have a legal case? if so how do I go about filing? I am still unemployed and you know the rest of that story...no $$$What is the name of your state (only U.S. law)? |

| Before you can even think about a legal case, you need to file a complaint with the EEOC first and once they give you a right to sue letter, then you can pursue legal action in court.

| Did you file for your unemployment? If so, what results. This will give you an excellent chance to get your materials together, see what the employer is saying about you. Of course, they are going to say you voluntarily quit. Your side is that you had a good job related reason to quit. Interesting to see how this plays out, while you are in the process of filing an EEOC case. Those things, however, take a long time, but they are the first step in pursuing a case like you describe here. |
