What is the name of your state? california
i'm trying to help my friend out.He was working for a construction company
and the security employee was constantly threatening and harrassing
him. Both men were working at the same job site(my condo complex).
Numerous false accusations were made against my friend which
eventually led to my friend's dismissal. My friend has requested written
copies of the allegations against him (in which the security employee
stated he had attempted to physically harm him on 3 separate occasions)
because he has no idea of what he's being accused of, however, the
security company has stated that a subpoena is needed to obtain that info.
Is this truly the case? What recourse does my friend have? How difficult is
it to prove libel?
Addendum to 3-16-03 message: I'm a homeowner@ this condo complex;
doesn't the "association" have an obligation to provide my friend and I the
opportunity to review the allegations made against him? He already has another
job, the continuing problem is this so-called security supervisor. I have documentation
galore re: his lies/ poor PR with other residents, etc. What recourse do I have?Thx!

"the security company has stated that a subpoena is needed to obtain that info.
Is this truly the case?"
*** Yes. They have no obligation to provide anything to you or your friend.

"What recourse does my friend have?"
*** Overly vague. For example, he can file for unemployment. He can find another job. He can move out of state.
If you mean against the security company, based solely on the information in your post, he has no recourse.

"How difficult is it to prove libel?"
*** Very difficult...... and expensive.
