No Job, No Certificate???

What is the name of your state (only U.S. law)? FL

I have been offered a job in another state which is dependent upon me getting my certificate from my current state. However, I have been told that I will not be issued a certificate for the following two reasons:

1. I am not a U.S. citizen (I'm a lawful permanent resident) and/or

2. They will only issue my certificate if I have a job in the same state (never mind the record high foreclosures, job losses, and budget cuts, particularly in FL).

Without the certificate, I will lose the position being offered. Furthermore, I'd understand if I am ineligible to get a certificate due being unqualified, but I am being denied a certificate I worked hard for!

If this misinformation leads to me losing the new job, do I have a case?

I believe that I have been misinformed and continue to deal with people who repeatedly throw out information that is contradictory to what is written in their rules or information that is not written at all.

Who misinformed you?

Why did you not research the licensing requirements before now?

Have you talked to the licensing authority to review your case?

I have been misinformed by certification specialists, and yes, I did my research that's why I'm here, because what I'm being told is not what I've read. There is one certification specialist who has been very helpful, but she is only one small part of this seemingly complex process. Now, I am currently researching in more depth in order to refute such statements, and I've found supporting information. I'm yet to talk to a licensing authority, because I only found this information out on Friday. Tomorrow, I will make one more attempt to resolve this issue, but if this is not resolved, I will take this situation very seriously. After one year of unpaid work, I don't plan on a second year of unemployment! I'm simply planning my next steps in case of losing this position.

My question should have been better phrased.

Why did you not research the licensing requirements prior to your certification classes?

You may be able to work on the in state job, but your immigration status is a hurdle too big to manage.

I was fully informed of the cert. requirements, that's why I confidently relocated. Initially, when I first spoke to a certification specialist, I was told "Sorry, you are ineligible because you are not a U.S. citizen." Shocked, I called back to speak to someone else, and they said the same thing. So, I asked to speak to a supervisor, who quickly could not understand why I was being told that information. Only to speak to someone again on Friday, who asked me whether or not I was a U.S. citizen and started to tell me I was ineligible, but we got cut-off due to bad reception. I should mention I have worked in FL so I've had to gone through the hiring process (as a lawful perm. res.) and I attended grad school there. Has anyone heard of such rules before?

You haven't told us what kind of certification you are talking about. However, have you told these people that you are a valid green card holder?

Yes, I have made my immigration status clear. I have not mentioned what type of cert. it is for the sake of anonymity. I will say, first thing this morning I had a conversation with someone today from the cert. dpt. and so far, so good. Now, all this back and forth has been an obstacle, so I'm hoping that things will work out for the best within my given timeframe.

My intention was to provide you with some general background information, in order to get pointed in the right direction. For the person not well versed when it comes to legal rights, I appreciated having your input, despite the outcome of my situation. Now, if I were to lose the position, then I would be happy to provide certain info. since I would plan on building a case, which I mentioned earlier. As it is right now, a supervisor is working with me to figure this out so I can get my cert. So, hopefully, no job will be lost!

The fact that you decided to not let us know what the certificate is - certificate of being able to fly, certificate of authenticity for J-Lo's autograph - really does not allow anyone to give any more help.

The specific certificate is the problem - it's impossible to help someone if you don't know what the problem is.
