President of company sending pornographic e-mails

What is the name of your state? Missouri.

I am a male manager of a small business. Three times over the last year a female staff member has complained to me that the president of the company (also male) has been sending pornographic e-mails to them (pictures). On the first two occasions I sent him an e-mail to stop. On this last occasion, I presented the company's owner with evidence.

THe owner is struggling with what to do. What steps do we need to take?

ps the president has been sued before for sexual harrassment.

The president of the company needs to be made to stop this behavior in whatever way it can be done, because if one of those staff members files a complaint with the EEOC, it will not go well for the company. Since you have been placed on notice that this is happening, the company can be held liable. I assume that the president serves at the will of the owner? Then the owner has to make it clear that this is a firing offense and that his job is in jeopardy. The owner also has to be prepared to follow through on that threat, president or not. I strongly suggest that the owner talk to legal counsel.

Ditto. The owner of the company has some SERIOUS liablity here. The evidence of harassment is irrefutable, the President has been told to stop and hasn't, the owner knows about it, and the President has previously been sued for sexual harassment.

The owner needs to make this stop immediately by whatever means are necessary, which may mean firing the President. Your company President clearly just doesn't get it. He is a HUGE liabilty for the company and the owner, who will find himself personally named in any lawsuit if things get that far.
