Sick LeaveWhat is the name of your state?What is the name of your state? OHIO I need some advise. I had surgery in December and required 8 weeks of sick leave before returning. I was called on the carpet when I arrived at the office by my boss and the Director of Human Resources. I was told that I would now have to sign in and out of work daily. I was accused of abusing sick leave and not working my hours (prior to my surgery I assume). Before leaving for December break I had met with supervisor and was told my job performance was good. No one else in my office, or in a similar position as mine is required to do this sign in and out procedure. I am also required to have a witness to each sign in (my boss is never there), so I usually ask a secretary or anyone I happen to find. I have to say, my boss doesn't like me, but I am in a school district running a very successful program with 18 years of excellence. I suppose it is hard to just get rid of me. I also am the lowest paid person at my level of authority. Anyway, is this harrassment, unfair labor practices, anything? This feels very wrong and I am either becoming paranoid or being mistreated. My belief is the latter, but I am willing to hear from someone else. Another tid bit, my boss has a personal relationship with my assistant director and her husband. He has repeatedly mentioned how he "loves" them. There is a clear and undeniable difference in my treatment and that of my assistant. Any advice? Zoe |

Did they have any reason to be upset with you when you returned, i.e. did you advise them of your status while on leave and when you would be returning to work? I was accused of abusing sick leave and not working my hours (prior to my surgery I assume). Is there any reason why they would feel this way, even if they are mistaken? No one else in my office, or in a similar position as mine is required to do this sign in and out procedure. I am also required to have a witness to each sign in (my boss is never there), so I usually ask a secretary or anyone I happen to find. Is there any reason why they be untrusting of your comings and goings? I also am the lowest paid person at my level of authority. To what do you attribute that? Is your educational level lower than your peers? Anyway, is this harrassment, unfair labor practices, anything? It could be construed as retaliation for taking FMLA but we need more information. Another tid bit, my boss has a personal relationship with my assistant director and her husband. He has repeatedly mentioned how he "loves" them. There is a clear and undeniable difference in my treatment and that of my assistant. Irrelevant. Favoritism based on a personal relationship is not illegal.

| In order to tell whether or not anything illegal has transpired with your sick leave, we need to know the following: 1.) How long have you worked for this employer? 2.) How many employees (approximately - I don't expect you to know exactly) does this employer have within 75 miles of your location? 3.) Do you work full time or part time? 4.) Counting EVERYTHING, how much time of for medical reasons have you taken off in the last 12 months? The eight weeks for your surgery plus what else? Doctor's visits, illnesses with relation to the need for surgery, EVERYTHING. The issues of your pay and the boss's favoritism are irrelevant to the issue of your sick leave. |

Needing advise on Familiy Medical LeaveI was not on FMLA at this time, I had accrued many sick days over the years and was able to use sick time during my recovery. The reason my supervisor questioned my use of sick time is that she saw me out with my daughters one day. It was my first day out of the house and I was feeling pretty good, but still not ready to work. She assumed I must be well enough to work. I kept my employer informed of my status weekly. My surgery involved several stages of recovery including physical therapy. I initially told my boss I would be back in 6-8 weeks. I returned 8 weeks to the day. I am not certain of why my hours were suddenly called into question. I have a job which requires me to be in my office and in the field at different times of the day. I always advised the receptionist of where I would be and was always reachable by my cell phone. Quote:
