wrongful treatment in the workplace


What is the name of your state? North Carolina
I am a waitress in a place where I have been for 3 years. The place used to be a great place to work at, but now it's a nightmare. The boss hired our floor man to be the manager. Every since that has happened we are constantly bieng treated awful at work. This stuff happens on a daily basis too. For example we had a meeting the other day and all our boss done was tell us that we were nothing but lazy a**es. And downed us the whole time.
Then the next day when I went into work, I ran next door to get change for the resteraunt. There is a gas station hooked to our business. My boss told me to go get change if we needed it. I was gone for only a minute, when I walked back in the new manager cursed me in front of all my customers loudly. Then one of my customers told my boss that I was a great waitress and they hated to see what happened this morning. Well, after work she asked to see me in her office, and jumped all over me for doing what she told me to do. Then the manager got right in my face and put his fingers right up in my face and told me never to talk back to him EVER!! My boss wouldn't even let me explain anything that went on. This stuff happens everyday to alot of us at that place. We are always bieng told that we are replaceable and that we are only hired for the day. Our jobs are threatened on a daily basis. We are also talked to lower than scum and cursed in front of our customers alot. I have had people tell me to go to the labor board. But, I don't know what to do. It's getting to the point where we are scared to even breathe wrong. Nobody likes it there anymore, because this abuse goes on daily. PLEASE HELP US, WE NEED SOME ADVICE ON WHAT TO DO..
What I have typed here is just an example of what goes on daily there, it does get worse at times. (more than not). Thank you for any help you can give us. Sorry it was so long.

While it truly does sound like a horrible place to work, nothing that you have described is illegal or gives you legal recourse with the labor board or anyone else. The law does not prohibit managers from being jerks - even world class jerks. Nothing in the law prohibits him from yelling at you in front of customers or contradicting his own orders. While he sounds like an unprofessional, thoroughly nasty person, he is not violating the law. It would be illegal if he were only treating women this way, or only hispanics, or only members of some other protected group, but since he's treating everyone lousy, it's legal. (Weird, huh?)

I'm by no means unsympathetic, having been in not dissimilar situations, but truly if this is the whole story your only recourse is to "vote with your feet" and find a more professional place to work.

One suggestion (not guaranteed); he must report to someone. Have you talked to HIS boss about it?

wrongful treatment


He is only treating the women of the workplace in this manner. Most of us are women. He treats the men in the kitchen completly different then he treats us. Thank you for your reply though, I highly appreciate it.

If that's the case you may have gender discrimination complaint. You can certainly see whether the EEOC or the state human rights commission thinks so!
