What is the name of your state? Pennsylvania (Montgomery County)

I have a friend who is currently 18 and a junior in High School. His mother does not work, and has recently remarried.

His parents charge him rent each month with no contract or written agreement at threat of kicking him out of the house if he doesn't pay.

I want to know if it is legal for her to charge him rent if she also claims him as a dependent.

Also, is it legal for a parent to kick their child out of the house if, though he is 18, he is still a High School student without sufficient income to support himself?

Pennsylvania Child Support
In Pennsylvania, child support is payable until a child reaches eighteen years old or graduates from high school, whichever is later. (The Pennsylvania Supreme Court declared that parents cannot be forced by a court to pay for college expenses of a child unless the parent has signed a written agreement providing for college support.) However, a duty of support may continue beyond the age of eighteen, if a child is unable to support himself or herself because of a physical or mental disability. The amount of child support that is payable in a case is based upon the monthly after tax incomes or earning capacities of the child's parents.

Exactly what does child support have to do with op's question?

Both Parents are " Equally " obligated by Law to support their children .

The Law States until 18 or still in high school which ever is later .

In school is later .

The answers are in child support obligations Law .

To directly answer the question , NO , they can not kick the 18 yr. old still in school out " legally " . If they were to the 18 yr. old could Petition the Court for CS from BOTH Parents .

And , NO the 18 yr. old in school is NOT " legally " obligated to pay rent .

That's what CS from the other Parent is for ..

When those CS obligations end then the Parent the teen lives with CAN demand rent or move out .
