Bullying


What is the name of your state (only U.S. law)? FL

Can I press charges if there is an indirect threat? "Keep talking and see what happens"

Did this happen at school? If it happened at a school, then the SCHOOL might be able to take administrative action.

I do not see this as a crime. I suspect you are out of luck. But, you can always call the police and see if FL has some unusual law that makes such a vague and conditional statement a crime of some kind. I can't imagine that will be the case, but you never know.

It was a text message, which I saved. It is happening in and out of school but related to things going on at school. I have brought it to the school, I have to wait to see how effective it is. And in 2008, FL did pass an anti-bullying law.

Then you will have to tie the comment to a school computer system or that it is occurring on campus, and that it is an ongoing pattern of behavior.

Keep in mind that this can be a two edged sword, so you had best be certain that what YOU have said in response does not qualify equally as harassment or bullying.

Again, thank you to everyone for your input. If a parent of on of the kids is intimidating my child, is there any leagal action I can arm myself with?

Intimidating in what way? Standing with arms crossed and staring at the child is likely no crime. Grabbing the kid by the neck and threatening to kick their tail would be a crime. What, exactly,is happening?
