My 16 yr old daughter was taken to the city police station and I was called - she was ticketed with dUI - for marijuana. She was administered a breath test for alcohol and blew a 0. She did have an open container of alcohol in her car and less than an ounce of marijuana in the car also. She was also ticketed for having the pot within a school zone $242.00 to the local cops and failure to drive on the right side of the road $242.00. Her DUI was referred to the juvenile dept. , along with a charge of being out after curfew. The cops did a urine test on her and said I could call for the results in 3-4 weeks. She swears she did not smoke any pot that day at all. The police say that she did not pass their field test and they called in their drug specialist and he said she had eye fluttering and something about the back of her tongue that said she was under the influence of pot. This is her first offense for any of this - what can we expect to happen? Do we need to consult a lawyer - I don't want her to skate on punishment she deserves but would of course like to minimize the effects of this on the rest of the family.

If you want her to look good in front of the court, get her into rehab immediately for her dope addictions.

She has extremely serious problems.

Rehab for pot "addiction"? Give me a break. What she did was dumb, but it hardly means that she's a junky. Make her deal with the legal consequences of her actions and hope that she learns a tough lesson.

Proving DUI

The cop has you do a drug test and sends it off to the state crime lab - does it tell them that you were doing pot within the last 4 hours or within the last 4 days? Can the cops prove that you were driving under the influence of pot or not. What does the judge consider when making his determination.
