What is the name of your state? New York.
I live in Utica, NY, and a friend of mine is seeking to become emancipated from verbally abusive parents. He is 16. His mother has admitted to slipping him pills in his drinks for a medication that he was prescribed, but which he elected not to take.
Googling for 'emancipation minor new york state' yields this:
http://www.empirestatecoalition.org/emanc.html
It says 'Emancipation involves the renunciation of the legal obligations of a parent and the surrender of parental rights over the child.' I'm not convinced, as a legal-savvy friend of mine is, that emancipation needs some sort of definite ritual. The signing of papers, or a hearing or similar.
I was unable to find more documents through googling that describe the definite procedure of emancipation. Some details I have to ask:
*Is an official renunciation of rights by the parent necessary, on paper, or can one just move out?
*Does a minor have to be absolutely self-sustaining to be emancipated? Can't he stay with a friend?
*Is the medication circumstance, described above, adequate justification for being emancipated through other means if the parents refuse to sign papers?
