Help my Son!!


What is the name of your state? California

My son was caught yesterday by our high school campus security durning 6 period being ''high'' from this Space Cake & cigerate he bought it from this drug dealer at school.

The Campus Security/and Probation Officer there searched his backpack and locker and proceeded to escort him to the Vice-Principal room and questioned him and he said a bunch of gibberish stuff until I came to pick him up..because I assume that the weed is messing him up (really badly)

He did admit eating half of it to the school officals.

I got a few questions:

1. My son wasn't arrested yet for poession of weed and cigerate (The cake itself is 1 gram THC and my son ate half of it)

2. If my son did give out the names of the drug dealers and other people doing drugs at the school would he still be arrested even if the school officals promised not to arrest him or charge him at all?or should this be handled via lawyer and DA?

3. I know that the school officals and the probation officer there can truthfully lie to me and my son so I am a bit concerned over his well being since its his 2 offense (his first one was 3-4 years ago and he got probation for a year for some other stuipid stuff)

4. Should I just plea bargin and send him to a safe place that help people recover from drug abuse and possibly avoid jail time?

5. Can the school officals and probation officer demand a urine sample from my son?

Never a good idea to buy drugs or other contraband AT school. It's bad enough to bring them, but to BUY them there!

Dope makes you goofy. And, yes, they had a right to search his stuff.

Did you take him to see a doctor, just in case he was suffering some adverse effects of whatever "space cake" might be?

Was there a question there?

They can always forward the matter to the police and he could be charged later.

The school has no control over prosecution of criminal offenses. In fact, they likely have little leeway even with regards to what will happen to him now. For buying and using controlled substances on campus he could face expulsion. If he only gets suspension, he should consider himself blessed.

If he is charged, you should get an attorney for your son. An attorney might be able to work out some kind of deal.

Then hire an attorney so you can run things past him before buying it on face value.

That is up to you. But, before you agree to anything, consulting an attorney might be a good idea.

They can DEMAND anything. Whether they can compel him to comply is another matter entirely.

As a condition of probation, he might have to give a urine test. As a condition of reinstatement at school, he might be asked to take a urine test. If officers responded to the scene, they could compel him to take a chemical test if they had cause to believe he was under the influence.

It all depends.

Nah! In the thread I was referring to, they were saying 5-0 for police. I told them the only 50 I knew was the rapper, but that was the wrong answer! So, don't tell me I'm not hip! My niece tells me enough. I don't need it from "you people" too!

actually, some schools do have the authority to have the student arrested on scene, my school does(I go to an alternative school though.) however, most schools cannot, and if they told you that there would be no charges pressed then immediatly go see a lawyer because be expecting the porkies within 2 weeks
