My daughter sent nude pics of herself to her boyfriend. She sent them via cell phone to his cell phone. She is 14 yo and he is 15 yo. The boyfriend's cell phone was confiscated at school on Friday and the assistant principal told him to turn the phone off and give it to her and she would give it back to him at the end of the day. The assistant principal turned the phone back on in her office and proceeded to view his text messages and pictures in his cell phone. Obviously, she saw the nude pics my daughter sent. My daughter was called into the principal's office today and was told by the principal, assistant principal and the school security officer, that she can face up to 3 years in Juvenile custody for sending the pics. Is this true?

I am not certain of the sentence, however it is true that it is illegal.

Since she is under 18, she made child pornography, and he viewed child pornography. The law was made to protect children from exploitation, however it also applies to people taking pictures of themselves (kinda silly).

the dilemma continues.....

I was told today, by the assistant principal, that there is some sort of pending law suit with the boyfriend's parents, and that if the law suit continues, that my daughter's pictures will be made public! Can they do that? :eek: No charges have been brought against my daughter or her boyfriend concerning the pictures, as of yet. Neither of them were written up at school or charged with any crime. How long can the school carry this out? Are they bound to any sort of time frame for charging my daughter? I am just really scared now, for my daughter, of course, and I just want to know what to expect! Seems like everyday it's something else! Should I attain an attorney now or do I have to wait until some actual charges are issued and my daughter is arrested? HELP!

Are you saying that the school has threatened to make public the child porn your daughter produced?

Yes. She said that if that law suit from the boyfriend's parents happens, that the pictures of my daughter will be made public. So, apparently if this law suit takes place, then my daughter is being thrown into the middle of it. I don't even know what the law suit is about!

If the teengirl took the photos and sent them, then how is she being THROWN into the middle of anything? :rolleyes::rolleyes::rolleyes: She's the author of her story.

I meant that it sounds as if she would be thrown in the middle of this law suit that I don't know anything about. I understand that she may still be charged for sending those pics, but how does that have anything to do with what the boyfriend's parents are suing the school for? That's what I'm confused about.

I have no idea what they are suing the school for.

But if the pix are produced in court, they will be kept under seal by the court.

Only authorized people will see them...meaning, probably everyone in the courthouse.

Thank you for your help. Yes, I figured that the pictures would be viewed by the entire courtroom, seeing as how it IS evidence. I love my daughter, but she has definitely committed a crime and she will just have to face the consequences.

She has a much larger problem than committing a crime.

After you get her on birth control pills, then get her into serious counseling.

Counseling began yesterday, and an appointment with my Gyn. is scheduled for Friday. We, as a family, are going to counseling, also, as it is very obvious that we need it. Thank you for all your help and for answering my questions. I really appreciate it.

And, obviously, she needs to have her cellphone, computer, television (i.e., anything requiring electricity to run it) away immediately. No more mall trips. No more car dates. Etc. etc.

She doesn't realize the enormity of what she has done.

I hope you do.

Oh, yes, I assure you that I completely understand the enormity of her crime. It is inexcusable, haneous, and just disgusting! You are right, though, she thinks this is all just some big joke and "not that big a deal" (her words). It is appalling to me that she thinks this way! She needs much psychological help and she needs to serve time in jail. Plain and simple. She is a criminal. Plain and simple. We go to court on May 22 and she is being detained by my and my husband's wishes in Juvenile Detention until her court date. The attorney, DSS caseworkers, and counselors have just been wonderful and I feel that my daughter will get the help that she needs. She is in for a rude awakening. I love my daughter and she is going to have to accept the enormity of her actions.
