What is the name of your state? Georgia
A 15yr. old male was arrested for eluding a police officer and wreckless driving on his 4-wheeler (ATV). Is the police required to tell him his Miranda Rights? Also, what is the penality for this? We were told he will not be able to get his license till the age of 18.

Miranda is only required when a person is both under arrest and being interrogated. If he were asked for his side of the story before being arrested, then there is no problem. They do not have to read him his rights simply because he is arrested.

Here's the best part about Miranda: if rights were not read, then any statements made in an interrogation after arrest just simply cannot be used in trial. It does not mean they get off scot-free. Nice try, though.
