my son is almost 17 , he has had no contact with his dad since he was 2, although he does pay child support lately, he would like to change his last name to mine, but doesnt want any contact with his dad, does he need his dads approval ,or does he have to wait till he is 18

Although you did not give the name of your US State, I'd advise him to wait till he's 18. He doesn't need anyone's approval or to give anyone notice once he turns 18.
