Probably. You NEED to get your child a lawyer, assuming s/he is the accused. AND therapy - ASAP.

Yes it is possible. The issue becomes whether or not the nine year old would be found competent. HOWEVER, depending on the situation, it could also be a due process issue. The facts would matter. Though I would state that the nine year old child needs to be in therapy AND have an attorney. In other words, I agree with the others but facts matter immensely. DO NOT DISCUSS THEM ON HERE.

Hopefully OP decides to come back and read the replies....

OP if this is your 9yo, therapy is crucial. A child that young who is acting out sexually (especially with a (younger) child) has very likely experienced sexual molestation him/herself.

Of course, if it is the 4yo that is yours - therapy is STILL crucial!
