Is this RIGHT?

What is the name of your state? Alabama My 17 yr old daughter received a naked pic of a fellow student on her cell phone...she showed this pic to another student..the principal called the local sherrif and along with being suspended for 3 days and having ISS (in school suspension) for one week..we had to go to sherriff's dept and meet with sherriff..he talked to the DA and decided not to bring charges against my daughter (wouldn't the other girl be in trouble too since she is the one that sent out the pic to begin with?) but did say that he was going to keep her cell phone for one year....can he do this?

I'd say the DA can do as s/he dang well pleases with how to proceed.

I agree and the reason is that the child porn distributor (your daughter) may have charges filed against her; they may need a year to decide.

pictures can be sent to anyone just like spam or junkmail. so I assume the decision would be whether she went to the friend with an "isn't this awesome!" or "what should we do?" attitude.
Could also be used as evidence in a case against the other girl.

Okay, this may be off the wall, but isn't this something children need to be educated about with all of their inherited media technology...?

Should the schools outline these rules in their annual school procedures/rules books that goes home to each family every year...outline that no pics, etc. should be exchanged at school, any nudity, etc. may cause expulsion.? What I am getting from reading posts here is kids do not have a clue what is OK and what is not with their cell phones.

We hand these kids cell phones and their is so much updated technology around them...pics...sending pics or anything...taking pics of anything...

Not to take the kids of the hook, but shouldn't a PARENTAL school bulleton annouce to parents what the rules are, so they can educate their kids? I almost wonderif, as parents, we hand our kids these cell phones in the name of having contact, and they naturally get abused. I see so many of the issues on this board as being kids are kids and will act like kids. The school and parents need to take a lot more responsibility in educating children that there are real adult laws that get crossed with certain activities.

I just do not see, not having a teenager YET, how these kids are supposed to be accountable and held criminal for a lack of basic education as to whats OK on the cell phone and what is not? Whose responsibility is this? The parents and the school policy.
