Tobacco/Under 18 YrsWhat is the name of your state (only U.S. law)? California ~~~~~~~~~~~ My son recevied a "courtesy notice" in the mail for being in the possession of Tobacco; it was PC 308 (b), now I read the definition of this penal code which says: "(b) Every person under the age of 18 years who purchases, receives, or possesses any tobacco, cigarette, or cigarette papers, or any other preparation of tobacco, or any other instrument or paraphernalia that is designed for the smoking of tobacco, products prepared from tobacco, or any controlled substance shall, upon conviction, be punished by a fine of seventy-five dollars ($75) or 30 hours of community service work.. Whle I have not spoken to my son yet to find out what his story is on this, I am wondering if some can answer me why the fine for this would be $328 for a first time offence! Are they saying that if we pay the astronimcal fine it won't go on his record and he won't have to community service? This ticket is about as much as running a red light...Really appreciate any help, advice, suggestions..thanks, |
