wreckless driving

i was speeding, much faster than what the offer says...i was doing 3 times the posted speed limit...the officer eventually caught up to me because im an idiot ...so i get hauled off to the juvenile detention center and stay till my proud parents get me...i had an expired provisional livence...we are on the graduated licensing system incase you dont know...so i got 3 tickets, wreckless, speeding 90+ in 45 (i was doing at least 130+) and i get driving on suspended license...i let every one down and am falling into depression and self loathing, this was last night...what kind of legal ramifications can i expect! im 17...18th B-day in 7 mos....and anu advise would be appreciated

Quit self loathing, so you let some people down, learn from it and don't do it again.

What are the codes to the violations?

the statute codes are: 66-5-39A suspended license, 66-8-113 wreckless, 66-7-301 for 91+ in 45 zone...what kind of fines can i expect??

66-8-113. Reckless driving.
This is a misdemeanor -- possible jail time-- 1st offense-5 to 90 days**(see below).
Fine ($ Range): 1st offense-$25 to $100
Points assessed to driver Six (6) points.

66-5-39. Driving while license suspended or revoked; providing penalties
Upon conviction, the person shall be punished notwithstanding the provisions of Section 31-18-13 NMSA 1978 by imprisonment for not less than four days or more than three hundred sixty-four days**(See below) or participation for an equivalent period of time in a certified alternative sentencing program, and there may be imposed in addition a fine of not more than one thousand dollars ($1,000). When a person pays any or all of the cost of participating in a certified alternative sentencing program, the court may apply that payment as a deduction to any fine imposed by the court...............


**There is no mandatory minimum term for jail or the fine.

66-7-301. Speed regulation.
Penalty for violating this code---More than 35 miles an hour over the speed limit fine $200.00 for additional fees (see below).

66-8-116.3. Penalty assessment misdemeanors; additional fees. (2003)
In addition to the penalty assessment established for each penalty assessment misdemeanor, there shall be assessed:
A. in a county without a metropolitan court, twenty dollars ($20.00) to help defray the costs of local government corrections;
B. a court automation fee of ten dollars ($10.00);
C. a traffic safety fee of three dollars ($3.00), which shall be credited to the traffic safety education and enforcement fund;
D. a judicial education fee of two dollars ($2.00), which shall be credited to the judicial education fund;
E. a brain injury services fee of five dollars ($5.00), which shall be credited to the brain injury services fund; and
F. a court facilities fee as follows:
in a county with a metropolitan court $24.00
in any other county 10.00

Standard answer

Here are some hints on appearing in court:

Dress professionally in clean clothes.

Do not wear message shirts.

Don't chew gum, smoke, or eat.

Bathe and wash your hair.

Go to court beforehand some day before you actually have to go to watch how things go.

Speak politely and deferentially. If you argue or dispute something, do it professionally and without emotion.

Ask the court clerk who you talk to about a diversion (meaning you want to plead to a different, lesser charge), if applicable in your situation. Ask about traffic school and the ticket not go on your record, if applicable.


Here are five stories that criminal court judges hear the most (and I suggest you do not use them or variations of them):

1. I’ve been saved! (This is not religion specific; folks from all kinds of religious backgrounds use this one.)

2. My girlfriend/mother/sister/daughter is pregnant/sick/dying/dead/crippled and needs my help.

3. I’ve got a job in [name a state five hundred miles away].

4. This is the first time I ever did this.

5. You’ve got the wrong guy. (A variation of this one is the phantom defendant story: “It wasn’t me driving, it was a hitchhiker I picked up. He wrecked the car, drug me behind the wheel then took off.”)
