15-day notcie?


What is the name of your state? Florida, Hernando county.
I have a tenant who repeatedly blasts loud music, argues with tenants. I told him multiple times to stop or I would evict.
The last straw, he called me at 2 am and 5 am, to wake me up, (on my caller ID), which I believe, is a crime.
I gave him a 15-day notice to vacate, with these reasons, and have filed at the court.
His attorney says, the lease says, I must, 1st, give written warning and a chance to cure, then 2nd, a 7-day notice, and 3rd, that I did not include his city after his address, on the 15-day.
The lease does not say 1- I must give him warning before a 7-day, it does say 2- I must give a 7-day, 3- there is on line where the address goes.
Is the 15-day enough? or do I have to start over with a written warning?

Read the Florida LL/tenant laws...
Yeah you have to start over.

Golly...
His lawyer is right...
There is no such thing as a 15 day notice...

You had better follow the law or the tenant could take you to court for damages. What is it about landlords that think that they do not have to follow the laws of their state. you are not above the law. in my state any rental contract that does not follow the letter of the law is not legal and the tenant can sue for damages.
