abandoned property


What is the name of your state? alabama

my tennant moved out on 10-01-06,the air conditioner compressor was burnt out and has to be replaced.i don't know where these people moved to but i have their cell numbers but they want return my calls-they had a storage shed moved behind the house when they moved in and when they moved out they emptied the storage building but it is still on my property.the size is about a 10'x30' building.it has been here now for 25 days-how long does it have to stay and can i sell it as abandoned property or sell for cost of replacing air conditioner compressor?

You can only sell the property when it is deemed "abandoned". The only way to do so is to send them a letter via CRR to their last known address. If that address is your rental place, send it there. The letter must state they have 30-days to retreive their property or your will deem it "abandoned" and will dispose of it as you see fit. You cannot sell it until you give them a chance to retrieve. If at the end of 30-days notice, send them another letter via CRR stating your intentions of selling the property since they failed to contact you. If the letters are returned unopened, DO NOT OPEN them, as they are evidence of your attempt to contact them. A judge will want to see them should the former tenants sue you for selling the items.
