addendum issue


What is the name of your state? nc

I moved out of an apartment in wilmington nc back in january. I signed an addendum to my lease for a transfer or responsibility to the other lease signee. I know for a fact that she was evicted and the court papers only stated her name for the eviction. However, I just purchased a car and two days ago I received a collections paper saying that I owe the apartment complex $1000. When I signed the addendum the property manager said that I could not be held accountable for anything that happened from then out. Now the apartment complex has switched management and I guess they are trying to stick me with the damages or whatever the fine is from. I luckily saved a copy of the lease addendum for transfer of responsiblity. I tried calling the apt and the new manager is out of town. They cannot hold me accountable correct? I asked the clerk of court and she said no, but I am still worried I will have to get a lawyer.

First of all, the court clerk is NOT an attorney.

Second, in order to give a legitimate answer we'd have to read the addendum so either hold it up to the monitor or type it here, word for word.

It states:

Transfer for Responsibility

This addendrum is hereby made part of the lease dated 6/25/2006. And all modifications thereto, between UDRT of NC, The ____ Apartments, Landlord, and MY NAME, Resident/Transferor on apartment BLANK. Resident/Transfer assigns all responsibilities for rent and damages and transfers all rights and title to the current deposit being held to THE OTHER LEASE SIGNORS NAME, Resident /Transfer for a period commencing on 1-6-2006 and expiring on June 27 2006. Resident/Transferee hereby agrees to become bound by all convenants and conditions therein contained as though the Lease were originally entered in me (us)/

Then the Community Director signed

Send the new owners a copy of the addendum and tell them to take it up with the previous owners.

So that addendum should protect me in regards to not being liable and them fixing my credit. I am pissed because I know it affected my interest rate on my car.

Then take the addendum and the original lease and any statements from your bank and / or finance company (if the interest rate was in fact, affected) to a local attorney for review.
