adding Tenant to lease

Here’s our situation…
We currently rent a house between 3 friends in a 1 yr lease agreement thru a reality company. We just started the process and was approved to add another tenant, but the reality company wants to up the rent due to “Normal wear and tear on plumbing, flooring, carpet etc.. from added adult traffic” which is what we thought the deposit was for. Is this a legit practice? The way they made it sound is if we didn’t agree to the increase, then no 4th tenant.


Also...
Before the original lease agreement it was brought up that a 4th roommate would be added in the future. And at the time nothing was mentioned about a rent increase.

3 weeks after move in a neighbor notified us that the subdivision had a home owners association and the said home owners association allow only Single families to occupy the houses in the subdivision...Due to the fact the real estate company knew this ahead of time, does this give us grounds to possibly break the current lease if it comes to that?

Tell them to pound sand. Unless specifically written in your lease that allows them to charge extra rent in the event of another addition, they cannot charge you more. Each state is specific in what the deposit is for. You will need to verify what the deposit will and will not cover with your states LL/T laws.

Ah... a Catch 22 here... In order for them to charge more rent, it would need to be written in your lease, BUT they do NOT legally have to add another person on the lease.

That is between the HOA and the Owner of the house.
