Advice from California


What is the name of your state? California

I have lived in a place and paid rent to my step dad and mother for over 2 years. When we moved into the place it was not painted and most of the doors where damaged and the carpet was old.

We ran into finance troubles and had to move out we wrote them a letter in Jan 2006 telling them we would be out by the end of Feb 2006 then they force us to move out in Jan. Today they say they are going to file charges against us for damages to the property. Like the doors, The water heater we told them was damaged many times, the carpet, the stove that was old when we moved in the kitchen sink that totted the wall behind the sink when they installed the garbage disposal and they are blaming it on us. Even thou we have witnesses that we told them many times off all the problems.

They figured sense we where family they did not have to worry about it. Now they are replace it all and want us to pay for it. What are My family rights if we have any.

The kids did write a little on the walls with crayons and we where going to clean it up but they told us to get out sooner than we wanted.

Family rights I know nothing about. However you posted in landlord/tenant issues and this I know.

You would be considered a month to month tenant. You were pushed out before the time. In landlord tenant language they did a no-no. However, you are out now.

You, I guess, did not have security deposit? Well if this was the case then you may have somethings you need to pay for.

If this was a "true-blue" Landlord/tenant, where you had moved in and paid a security deposit, and they fixed things as they should have according to landlord tenant law, then you would probably either get a refund or the Deposit would cover any damage.

You are trying to take advantage of the "family" connection just as much as they did when you lived there.

I see money going from you to them in the future, how much is your responsibilty??? Heckfire if I know.

They should send you an itemized list of damages within 21 days by CA law, however I don't see anyone following the laws in this scenario.

Thanks for the fast response back yes I know I may have to pay some but don't feel that I should have to pay all.
