Hello I live in Florida and planning to break my lease early. I just re-signed my lease so I have almost a entire year left. I have read over the lease and understand that I am liable for the rent until a new tenant is found. I plan to repaint the place (because I had painted it a different color) and fully clean up the place. I even plan to find a new tenant myself. However this is my problem. I read in the tenants rights handbook that a landlord cannot keep your security deposit because breach on lease; he can only deduct for damages. However when I presented this to my landlord in a letter he informed me that they NEVER return deposits when people breach a lease. Then he mentioned that it didn't matter because when they deduct for preparing the apartment that it will all add up to the deposit anyways. I gave a deposit of $1250. If I repaint the place myself can they deduct for repainting the place? I am confused. I understand that I am breaking my word but why should they keep $1250 if I am trying to do all the work myself like posting adds in the newspapers. Also my bathtub has been needing re-painting for over half a year. After promising several times that they would come an fix it they never did. Now they say that they wont fix it until I move out. But I can't show the apartment with the bathtub the way it is; it is disgusting! Please HELP. WHAT ARE MY RIGHTS ON SECURITY DEPOSIT.
