CA - Late Rent w/ Commercial Lease

Commercial lease expired 9/30/04. No lease extension, new lease or amendment to extend lease term was executed since 9/30/04. :eek: Lease has NO terminology regarding automatic renewal once lease term is up (standard AIREA form used). Lessee is 2 months past due on rent. Can I proceed with the 3 day pay or quit notice?

The 3-day pay/quit specifically applies to residential rentals only.

Your written lease should guide actions for non payment.

Also may depend on local laws if any regulating commercial rentals.
