I live in wyoming and have a lease until jan 2003. My husband was injured on the job and still haven't received payment. We are forced to move, because we don't have money for next months rent. All of our stuff is in a storage facility, while we stay with family to get out of debt. Is it legal for our landlord to put a lien on property that is not on his premises??? We will be back for our stuff(we are moving with family 5 hours away) can he put a lien on our storage and if so how, and how long does it take and will it prevent us from getting any of our stuff?? and what would he have to do legally to do it? a quick response would be great!!

The landlord lien only applies to tenant properly left on premises. As long as the storage unit isn't on the rental property, it is exempt from the lien.

So you are leaving the landlord in a bind......

There is No one to pay his rent in a few days and you think you can get away with this?

What have YOU DONE to find a new tenant?

What have YOU done so you dont owe the landlord any money?

If you just up and leave he will sue you in court for all the months left on the lease, and bill collectors will call you in a few months.

So you'd better apolgize to the landlord make sure ads are in this sundays paper help show the apartment and hope a new tenant moves in asap.

and get everything in writing or YOU WILL be sorry!

Ignore 'rentertoo'. He has NO legal knowledge and only insists on spouting his inane, biased, personal opinions (that have gotten far more in trouble than helped).

Further, he has already been kicked off this forum numerous times under other names, but like all cockroaches, keeps coming back.

Personally, I think he gets his 'jollies' by insulting and degrading people. That is the only reason that I can come up with for someone who seems to have a 'fetish' about posting his drivel here. He is probably a lot like those actors on NYPD Blue.... an "agoraphobic, alcoholic who sits in his chair looking out on the streets of New York... too afraid to venture out into the world, so must limit his view to only the street seen from their window. His entire life must be viewed through the bottom of a bottle, or in the glow of his computer monitor."

If landlord can get service on you and get a judgement and knows where your stuff is located, there is a small chance he can seize it with court order. Lots of hassle for very few bucks so it is highly unlikely.

HOWEVER, do pay your storage fees well in advance because the storage facility CAN take your stuff and sell it if you don't pay your storage rent.
