we live in florida. we moved into a new apartment building. we are on the second floor. cigarette smoke is leaching into our apartment via the stairs. it is also leaking into our dryer vent and onto our clothes. is this a health code violation. we want to withhold rent until the sitation is resolved. can we?

Probably NOT......you did not inform the landlord you wish to live in a non smoking building, and there is nothing in your lease to that effect..

Time to get some of those $199 Hepa air cleaners...
