We went apartment hunting after selling our house in 2005. We were attracted to a small four unit apartment building, one that, according to our lease, allowed no smoking or pets. For a whole year, everything was fine. Then a new tenant moved in next door, a person who smokes. Her smoke was coming directly into our apartment, not via the hall between, but apparently through the air exchange system. I notified the landlord who found that the air exchange system was not working - filters had not been cleaned for several years and fan was seized up.
The filters have been cleaned and the fan replaced, but the smoke continues to come into our apartment. It clears faster, but it is still a serious problem.
What are our rights in this situation? What options are open to the landlord? Can he stop the tenant from smoking in her apartment? Can he evict her for smoking?
We really like this apartment. Apartments are scarce in this area and we do not know of any that even close to the amenities of this place - except for the smoke!
