Does anyone know for certain if a commercial lease is in effect for the term of the lease if it was signed by the landlord, not signed by the leasee, but required rent has been accepted? I have asked 3 different lawyers and been given 3 different answers - 1. The lease is not in effect 2. The previous lease signed by both parties is in effect on a month to month basis. 3. The lease is in effect for the term because the landlord accepted the rent payment. Note: In a correspondence from the landlord presenting another lease a statement reads: "Payment of the rent without signing the lease implicitly deems the lease accepted in its entirety."
