Hi - my tenants want to break their lease earlier than the end of lease term. I have agreed to it so long as they agree to pay for my costs to advertise the place and a broker fee to re-rent the place to new tenants. They deny to pay for this broker fee charge(but are still leaving the lease early anyway), though my lease contract clearly indicates this potential cost in the event of a breach.
Can I withhold this fee out of their security deposit, or do I have to file a separate claim to collect this fee from them?
What other costs can I typically charge b/c of the re-renting?
