I am hoping someone has some advice here. My father's tenant, in new York City (I'm looking after the property for him)already has an eviction notice, and they need to be out by March 15th. They already have a new apartment, and have moved their telephone service, and cancelled their gas account. I beleive they still have items in our apartment, and haven't moved completely.
Here's the questions..We can see partially into the living room windows and they are tearing the panelling off the walls. The other tennants have also been hearing sawing and electric drills going, so who knows what other damage they are doing. I called the tenant and told him I wanted acess to the apartment and they refused. Is there anyway for me to get in and stop the destruction?

Why do they have such a LONNNNNNNNg time to get out that is over 2 months?

Please explain......and where is the apartment? any parking available? is it a 2 family house, co op condo? I always know good responsible people who need nice places to live.

I would STRONGLY urge you to go in with your attorney to verify any damage, and at least bring a disposable camera or two or a camcorder, do not go in without it.

Then you might be able to get them out real fast and sue them for damages, PLUS attorney fees!

Also get their new address and phone # you will need it to serve them any court papers...not to mention their place of employment.

Thanks for the replies. I don't know why they have almost 3 months to move. My father co-owns with an aunt, and it was her lawyer who managed the eviction proceedings. (aunt & father are not on speaking terms..long story)When I called my father's lawyer here in NY I was told we'd just have to "deal with it". I couldn't understand that!

Actually, that's not the only attorney I got that answer from. Anyone know of a good one? I only seem to be running across the "nice guys". Where are all the "pit bull" lawyers??? I am calling the tenant again tomorrow and letting them know I want in. Anyone know if the local precinct will let a police officer escort me. The guy's a little nuts! Might also help to document the damage?

Though i havent seen too many cases recently from them, In the New York Law journal as far as being nasty and dirty to tenats....but they do only represent landlords.

But Borah Goldstein et all.....is probably the nastiest so far.... but both they and Bruh will really run up a tenants legal bills!
